Sun Entertainment Corporation Obtains Default Judgment and Permanent Injunction

NASHVILLE, Tenn., Aug. 16 /PRNewswire/ -- Nashville based Sun Entertainment Corporation has obtained a default judgment and permanent injunction against John Lamonte and his company, Creative Sounds, Inc. of Sedona, Arizona. The orders for both actions were signed by U.S. District Judge Elaine R. Bucklo of the Northern District of Illinois, Eastern division, and entered into the court record on July 23, 2007.

The action stemmed from an intellectual property auction that was scheduled to be held in Chicago on April 18, 2007 by Chicago auction house, Ocean Tomo. One of the lots in the auction was a group of master recordings by well-known Sun artists that was placed for auction by Lamonte/Creative Sounds. Lamonte's ownership of rights to certain masters, and Ocean Tomo's subsequent right to sell the master rights at auction, was challenged by Sun and other parties including Sony/ATV Music and the RIAA. At the 11th hour, Ocean Tomo pulled the lot containing the challenged masters from the auction.

Sun continued its action against Lamonte/Creative Sounds, which culminated in the default judgment and permanent injunction. Master recordings embodying the performances of original Sun artists Johnny Cash, Jerry Lee Lewis, Carl Perkins and Charlie Rich, among other Sun artists, were included in the cancelled auction lot.
