Judge Rejects State's Demand for All of Rush Limbaugh's Medical Records
MIAMI, June 24 /PRNewswire/ -- Roy Black, Rush Limbaugh's attorney, issued the following statement regarding the decision today by Judge Thomas Barkdull III to review the medical records seized from Mr. Limbaugh's doctors and return any records not relevant to the investigation.
We are pleased that Judge Barkdull has agreed with our position that the State was not entitled to the wholesale seizure of Mr. Limbaugh's medical records. We are finally getting the judicial review of the records for relevancy that we have sought from the start.
This is also a positive result for all medical patients in Florida because it affirms our argument that the police cannot go on a fishing expedition through anyone's most private medical matters. At the very least, there will be a judge between the police and the medical records.
We are also pleased with the Judge's order that any notes the prosecutors made during their brief review of the records in December 2003 will be held securely by the Clerk of the Court until further order of the Court.
We continue to believe that the search warrants were issued based on faulty and misleading statements from investigators and that the search was improper under both state and federal law. Nothing in Judge Barkdull's order prevents us from renewing our motion to suppress all of the records at a later date.
