Federal Court Puts Radio Show Hosts Back on Air
Philadelphia Ruling Impacts Broadcast Format-Change Issues
PHILADELPHIA, April 26 /PRNewswire/ -- Preston Eliot and Steve Morrison, two popular Philadelphia morning-drive radio personalities, have won a federal court ruling today, preventing their former employer from taking further steps to enforce non-compete clauses in their employment agreements.
The U.S. District Court in Philadelphia issued a preliminary injunction Tuesday, finding the non-compete clauses are unenforceable because Preston and Steve's former employer, Radio One, Inc., shut down the modern rock station at which Preston and Steve previously worked, and no longer operates any rock station in the Philadelphia market.
The non-compete clauses barred them from appearing on air for other stations in Philadelphia for six months.
"We are ecstatic that the Court found in our favor, and are thrilled to get back on air on WMMR. We look forward to reconnecting with our listeners," said Steve Morrison.
Added Preston Eliot: "It was painful -- even for two months -- to be off the air. "We missed our listeners and friends, and missed being part of the morning commute in Philadelphia."
