SpectiCast Sues Drake Over "Lost" Footage





LOS ANGELES, March 19, 2015 /PRNewswire/ -- SpectiCast, a highly respected distributor of digital films with content ranging from the art of the Vatican to the music of Paul McCartney, sued the Grammy-award winning singer Drake on March 18 in Los Angeles, charging him with libel and intentionally interfering with the successful global release of the film.

SpectiCast is releasing a Drake concert film today, March 19, in some 350 theaters across the United States, and hundreds more abroad. The film records an early concert performance of Drake in Toronto in 2009. The film is called "Drake's Homecoming: The Lost Footage."

According to the complaint, Drake authorized the film and continues to have a financial interest in it. Yet, as set forth in SpectiCast's complaint, Drake this week decided to engage in a libelous campaign to sabotage the success of this movie, by issuing false statements to millions of followers on Twitter and Facebook that the movie was "unauthorized" and that he had "no part" in the movie.

"This film is a concert film showing Drake's sold-out performance in 2009," said Peter Haviland of Ballard Spahr, attorneys for SpectiCast. "Drake authorized the filming, he was paid for it, he still has a financial stake in the movie, and his current statements to the contrary are completely false. SpectiCast is a respected distributor. As we state in our complaint, Drake's actions are libelous, malicious and damaging to those who worked hard and honorably to get this movie out."

The complaint alleges that Drake's comments constitute libel and intentional interference with SpectiCast's business because Drake did in fact authorize and endorse the film. The complaint also asserts that Drake's comments, in which he says he is seeking to "protect his fans" from the film, damage SpectiCast's reputation for providing high quality, fully authorized content. The complaint states that Drake is likely seeking to direct his fans to content released by his own company, "October's Very Own."

"SpectiCast is seeking substantial damages, including punitive damages and a declaration from the Court confirming that its release of the 'Drake's Homecoming: The Lost Footage' is fully authorized," said Haviland.
