Global Music Group of Delaware True Bidder for Assets of Death Row Records

LOS ANGELES, July 15 /PRNewswire/ -- GLOBAL MUSIC GROUP a Delaware Corporation as Plaintiff filed a civil lawsuit Friday in Superior Court of the State of California Case no. BC394278 to assert their claim as rightful bidders of the assets of Death Row Records and to prevent the assets from falling under the control of a group controlled by former partners.

Ron Goldberg, CEO of the company and of Alliance Capitol, LLC, its parent, announced that he filed the action against Global Music Group, Inc. a New York Corporation formed a day before the bid on June 9, 2008 by Global (Delaware) former president Anthony Marotta after Goldberg's Delaware company had retained counsel in March, 2008 and applied to be a bidder at the bankruptcy auction to be held June 24, 2008. Anthony Marotta and his new partners, RSB Investment Strategies, LLC, through the newly formed corporation with the identical name are claiming they own the assets of Death Row Records.

However, Goldberg said, "I have non-circumvent and non-compete agreements with both Marotta and RSB that prevent either from claiming to be the party in interest in the bankruptcy auction that determined the eventual owner of Death Row Record's assets."

Goldberg has demanded that the parties involved in both Global Music Group, Inc. of New York and RSB cease any business pertaining to Death Row Records and specifically he states, "Susan Berg, Kathleen March, Ronnie G. Bush, Anthony Marotta, Anthony Davi, Jr. and Jeff Davi, who is current head of the Department of Real Estate of the State of California, are all in breach of their agreements with me." The complaint that has been filed contains Breach of Oral Contract, Breach of Written Contract, Misappropriation of Trade Secrets, Intentional Interference with Contract and Economic Advantage, Breach of Duty of Loyalty, and Unfair Competition causes of action. Goldberg is seeking a Constructive Trust with a Temporary Restraining Order to prevent the transfer of the assets.

"When the Court sees the documents signed by the defendants that I rely on and when the work I did for a year in advance of the bid is made public, it is beyond question who owns this record label," Goldberg said.
